Terms and Conditions (T&C) – PHILYPPS
1. Scope
These Terms and Conditions apply to all orders placed by consumers through the online store of PHILYPPS.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the “Buy Now” button, you submit a binding offer to purchase the goods in your cart.
You will receive an automatic order confirmation email after placing your order. This confirmation does not constitute acceptance of your order.
The contract is only concluded when we accept your order by sending a shipping confirmation email or by dispatching the goods.
4. Prices and Shipping Costs
All prices are stated in Euro (€) and include applicable VAT.
Additional shipping costs may apply and will be clearly indicated during the checkout process.
5. Payment

Payment is due immediately upon order.
6. Delivery and Shipping
Delivery is made to the address provided by the customer.
Estimated delivery times are indicated on the respective product page or during checkout.
If a product is unavailable, we will inform you promptly and refund any payments already made.
7. Retention of Title
The goods remain our property until full payment has been received.
8. Right of Withdrawal
Consumers have the right to withdraw from this contract within fourteen (14) days without giving any reason.
Withdrawal Instructions
The withdrawal period is fourteen days from the day on which you or a third party named by you (who is not the carrier) has taken possession of the goods.
To exercise your right of withdrawal, you must inform us (PHILYPPS, contact details above) of your decision by means of a clear statement (e.g. email).
To meet the withdrawal deadline, it is sufficient that you send your communication before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs arising from a different type of delivery than the standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive your withdrawal notice.
We may withhold reimbursement until we have received the returned goods or you have provided proof that you have sent back the goods.
You will bear the direct cost of returning the goods.
9. Warranty
The statutory warranty rights under applicable law shall apply.
10. Liability
We shall be fully liable for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
In cases of slight negligence, we shall only be liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable damage typical for the contract.
Any further liability is excluded.
11. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR).
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Governing Law
These Terms shall be governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
13. Final Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
